Welcome to Ibiza Chic Boutique. These general terms and conditions apply to all contracts with Fidanzia Bags. By placing an order with Ibiza Chic Boutique, you agree to these terms and conditions. Article 1 - Definitions

In these general terms and conditions, the following definitions apply:

  • Withdrawal period: period during which the consumer can exercise his right of withdrawal.
  • Consumer: a natural person who is acting for purposes which are not related to his trade, business or profession and who enters into a distance contract.
  • Day: calendar day.
  • Fixed-term contract: a contract that has a limited duration and that relates to a number of products or services.
  • Durable medium: a medium that enables the consumer or company to store information and to recall it later without modification.
  • Right of withdrawal: the consumer's right to withdraw from a distance contract within the withdrawal period.
  • Company: the natural or legal person offering products or services at a distance.
  • Distance contract: a contract concluded exclusively by means of distance communication.
  • Means of distance communication: a means by which a contract is concluded without simultaneous physical presence.
  • General Terms and Conditions: the company's terms and conditions.

Article 3 - Scope

These general terms and conditions of business apply to all offers made by the company, as well as to all distance contracts and orders between companies and consumers.

Before a distance contract is concluded, the text of these conditions is made available to the consumer. If this is not possible, it is indicated where the conditions can be viewed and that they will be sent free of charge.

If specific conditions relating to products or services apply in addition to these conditions, the latter shall apply in addition. In the event of contradictions, the consumer may appeal to the provision that is most favourable to him.

Should individual provisions of these conditions be ineffective or void, the contract shall nevertheless remain valid. The ineffective provision shall be replaced by a provision that is as equivalent as possible.

Unclear or unregulated cases will be evaluated according to these conditions.

Article 4 - Offer

  • If an offer is time-limited or subject to conditions, this will be expressly indicated.
  • The offer is not binding. The company can modify it at any time.
  • The description of the products or services is accurate and complete. If images are used, they show the products as realistically as possible. Obvious errors in the offer are not binding.
  • All images and information are indicative. Differences do not give the right to terminate the contract.
  • There may be colour differences between the images and the actual products.

Each offer contains clear information on:

  • the price (excluding customs duties and import VAT, to be paid by the customer).
  • the shipping costs.
  • the conclusion of the contract and the necessary steps.
  • the possibility of withdrawal.
  • the terms of payment, delivery and contract.
  • the duration of the offer or price guarantee.
  • the additional costs for means of distance communication.
  • Storage of the contract and access methods for the consumer.
  • Possibility of correction for the consumer before the conclusion of the contract.
  • Other languages available for the contract.
  • Applicable codes of conduct and how to consult them.
  • Minimum duration for long-term contracts.
  • Available sizes, colours and materials (if relevant).

Article 5 - Conclusion of the contract

  • The contract is concluded when the consumer accepts the offer and fulfils the conditions.
  • In the case of an electronic order, the company immediately confirms receipt. In the absence of confirmation, the consumer can withdraw from the contract.
  • The company adopts adequate security measures to protect electronic data.
  • The company may carry out credit checks. In case of justified doubts, the order may be refused or subject to special conditions.
  • After the conclusion of the contract, the consumer receives a written or electronic confirmation with important contractual information.

If a product is not available, the contract is concluded subject to availability.

Article 6 - Right of withdrawal

  • The consumer can cancel the contract within 90 days of receipt of the goods without giving any reason.
  • During the cancellation period, the product must be treated with care. It may only be unpacked or used to the extent necessary to check its condition.
  • To exercise the right of cancellation, the consumer must notify the company in writing or by email and return the product within 90 days.
  • If the product is not returned within the established term, the purchase contract remains valid.

Article 7 - Costs in case of withdrawal

  • The return costs are charged to the consumer.
  • Payments already made will be refunded within 14 days of receipt of the goods.

Article 8 - Exclusion of the right of withdrawal

The right of withdrawal is excluded for:

  • Products made according to the customer's specifications.
  • Personal or perishable products.
  • Sealed hygiene items, if the seal has been removed.
  • Audio and video recordings or software with an open seal.

The right of withdrawal is also excluded for certain services, for example:

  • Fixed date travel, transport or leisure activities.
  • Services started with the consumer's consent before the withdrawal period has expired.

Article 9 - Prices

  • Prices remain fixed for the duration of the offer, except for changes in VAT.
  • If prices depend on market fluctuations, this will be stated in the offer.
  • Price increases within 3 months of the conclusion of the contract are only permitted if provided for by law.
  • After 3 months, price increases are only permitted with the consumer's consent.
  • All prices are subject to change. No claims can be made as a result of printing or other errors.

Article 10 - Warranty

  • The company guarantees that the products and services comply with the contract and the legal provisions.
  • The legal guarantee remains unaffected.
  • Defects must be reported within 14 days of receipt.
  • The guarantee is not valid in case of improper use or repair attempts by the user.

Article 11 - Delivery

  • Delivery will be made to the address indicated by the consumer.
  • In case of delay or unavailability of a product, the consumer will be informed within 30 days and may cancel the purchase.
  • In case of cancellation, the purchase price will be refunded within 14 days.
  • If a product is unavailable, a replacement product may be delivered.
  • Products are shipped from our warehouse in Asia.

Article 12 - Duration and termination of contracts

  • Consumer contracts for an indefinite period may be terminated with a notice period of one month.
  • Fixed-term contracts end automatically, unless renewal has been agreed.
  • Contracts may not be tacitly renewed for a long period.

Article 13 - Payment

  • Incorrect payment information must be reported immediately.
  • In the event of non-payment, reminder fees may be applied.

Article 14 - Complaints

  • Complaints must be submitted within 7 days of discovering the defect.
  • The company will respond to complaints within 14 days.

Article 15 - Disputes

  • German law shall apply exclusively.

Article 16 - CESOP

Payment service providers may report transactions to the Central European Payment System (CESOP) in accordance with the new legal regulations.
